Terms and conditions – Logan Live Music Month Artists
1. Eligibility
- a. At least 50% of the musical act must reside in the Logan Local Government Area identified by postcode.
- b. Musical acts are eligible to apply once only, however members of musical acts may also apply to perform as individual artists in their own separate application.
- c. Applicants must register online and fully and legibly complete all sections of the online entry form.
- d. Council employees and elected officials are not eligible to submit an application.
- e. If selected, the act will have public liability insurance to the value of $20 million and provide a copy of the Certificate of Currency to Logan City Council.
2. How to enter
- a. Applicants must complete the application form online and provide:

- a web link, mp4 or mp3 file of a performance by the act
- one image of the musical act for publicity (high resolution, JPG format)
- b. Applicants must be able to produce, upon request, written, signed and dated evidence of permission from any people appearing in the image submitted.
- c. Entries must be a maximum file size of 50MB.
- d. Only digital files will be accepted as part of the registration process. Printed material, CDs, DVDs and/or vinyl will not be accepted.
- e. Applications are open from 11 March, 2020.
- f. By submitting an application to Logan Live Music Month, the Applicant agrees to be bound by the terms and conditions outlined in this document.
3. Professional development
- All shortlisted participants will be offered the opportunity to undertake professional development activities organised by Council.
4. Performance/film guidelines
- a. Council reserves the right to refuse any submission deemed unsuitable for public viewing. This includes material deemed to be offensive, illegal or that may otherwise be potentially embarrassing to the host venue or Council.
5. Copyright, moral rights and privacy consent
- a. The Applicant warrants that they are the owner(s) of all copyright of all promotional materials provided (including but not limited to image, video and/or song) (“Materials”) or have obtained all necessary approvals to permit the submission of these Materials to Council.
- b. The Applicant, as the owner(s) of these Materials, grant Council the right to:

- maintain a copy of all submitted Materials for archival purposes;
- display Materials in public spaces for the duration of Logan Live Music Month;
- publish on Council’s website and social media platforms; and
- use the Materials for promotional and publicity purposes relating to Logan Live Music Month.
- c. By entering Logan Live Music Month, the Applicant grants permission to Council and/or their agents or contractors to make such use as they may choose in their sole discretion of any Materials digital or otherwise recorded in any format, including the images of any child or individual appearing in the Materials for whom the Applicant has substituted decision making responsibility. Council may reproduce the Materials in any form for any purpose, in the future, in whole or in part. Distribution of the Materials may be by any medium including the terrestrial broadcast internet, printed media, and other multimedia. This consent is perpetual, non-exclusive transferable and royalty free.
- d. Council will acknowledge the musical act’s name in all publicity of Logan Live Music Month as the creator and owner of the Materials.
- e. While Council will take care to ensure the quality and integrity of the reproduced Materials, the Applicant acknowledges that enlargements and slight variations may result from adapting the original to required formats.
- f. Council may organise for photography and videography of Logan Live Music Month performances for documentation and promotional use. By agreeing to these terms and conditions, the Applicant also consents to photography and videography of them and their Logan Live Music Month performances, and the right of Council to use and publish these Materials solely for the purposes of documentation and promotional.
6. Responsibilities
By agreeing to these terms and conditions, the Applicant is agreeing to:
- a. attend the confirmed and agreed upon performance/s scheduled for Logan Live Music Month 2020;
- b. attend scheduled Logan Live performance/s with all necessary gear, equipment and/or instruments to perform;
- c. actively promote Logan Live Music Month 2020 and the upcoming performance/s (through social media platforms etc.);
- d. respect venue dress codes and terms of entry when attending the scheduled performance/s;
- e. maintain professionalism at performances with attire, language and behaviour, based on the understanding that all Logan Live performers are publicly representing themselves and Logan City Council at these Logan Live Music Month events (including that Logan Live performers will not damage the performance outcome or tarnish the professional Logan Live image due to alcohol consumption, and will not be under the influence of drugs or excessive alcohol during their scheduled Logan Live performance/s);
- f. maintain prompt contact to confirm performance arrangements, and provide no less than 24 hours’ notice in the event that cancellation of a performance is required (with the understanding that Council may require additional confirmation of the reason for cancellation).
7. General conditions
- a. Council reserves the right to modify these terms and conditions at any time and to cancel or amend the program at any time without notice or further recourse to the Applicants.
- b. Logan Live Music Month is being presented and promoted by Logan City Council ABN 21 627 796 435 acting through Libraries and Creative Industries Branch whose principal offices are at 150 Wembley Road, Logan Central.
- c. Performance payments for Logan Live Music Month performances are calculated from a standard rate per act as per Musicians Union fees. Upon being selected as a successful applicant, a quote will be provided for artist confirmation prior to event scheduling being finalised to ensure that this amount is mutually agreeable before continuing with performance planning.
